Silverglate, Dershowitz Debate Campus Speech, Harassment Rules

At a Harvard Law School event, Harvey A. Silverglate '67, author of "The Shadow University," called for the repeal of campus speech codes, particularly criticizing HLS' sexual harassment guidelines. Silverglate argued these guidelines, enacted in April 1995, constituted "postmodern censorship" and were more about political reaction than addressing legitimate claims. During the event, Frankfurter Professor of Law Alan M. Dershowitz, who initially introduced Silverglate, defended the guidelines. Dershowitz emphasized the need for specific rules to prevent baseless accusations. The session turned into a debate, dividing the audience of over 70 attendees. Some, like first-year law student Sarah Szalavitz, supported the guidelines for ensuring a harassment-free environment, while Silverglate maintained that such school-wide standards were unnecessary due to the rarity of harassment cases.
