Bok Rejects Dalton Tenure Appeal

President Bok announced he would not grant tenure to Assistant Professor of Law Clare Dalton, who had alleged gender and political discrimination by the Law School faculty. Bok’s decision concludes a three-year tenure dispute, possibly leading to a gender discrimination lawsuit against Harvard. Bok consulted a panel of five legal scholars, who reached a consensus not to recommend Dalton for tenure. Dalton, an adherent of Critical Legal Studies, had initially received insufficient votes for tenure due to alleged insufficient scholarship and later faced a faculty vote denying her promotion. Dalton criticized the tenure review process as discriminatory and is considering litigation. The tenure review panel, criticized for lacking diversity and CLS representation, included prominent legal scholars with Harvard and Yale ties. Dalton's lawyer argued the review failed to address discrimination claims.
